Legislative Council Report ¥ßªk·|¤u§@³ø§i (1998-2004)
Dear Fellow Engineers,
Given your full confidence and support, I am most honoured to be able to serve the Engineering Functional Constituency in the Legislative Council as your representative in the past years. For the well-being of engineers and the best interest of engineering sector, I have been making every effort to:
1. Maximise engineers¡¦ role and safeguard the engineering constituency
2. Push for more public works to create employment opportunities
3. Secure engineers¡¦ livelihood and speak for the engineering profession
4. Promote social awareness and political culture among engineers
I am glad that my endeavours have earned your recognition and have produced some concrete results. For your perusal, I have prepared this short report which aims to give you a summary of my work and activities in the Legislative Council from 1998 to 2004. 1. Maximize engineers¡¦ role and safeguard engineering constituency
µo´§¤uµ{®v§@¥Î «O»Ù¤uµ{¬ÉÅv¯q
Ø Successfully convinced the government to issue bonds to finance more infrastructure projects
Ø Successfully persuaded the government to extend its deadline for eliminating fiscal deficit for 2 years to 2008-9, to ease pressure on raising taxation and further belt-tightening
Ø Successfully persuaded the government to adopt Private Finance Initiatives (PFIs) to increase volume of infrastructure and building works for the industry
Ø Strongly objected to privatisation of the Water Supplies Department or any existing government services and facilities such as water treatment plants
Ø Successfully pressed the government which was confirmed in Mr C H Tung¡¦s Policy Address to forsake its wrong policy on recurrent funding for capital works projects
Ø Lined up HKIE to offer advice to the government in combating SARS
Ø Strongly objected to government¡¦s housing production target of 85,000 initiated in 1997 which, as a consequence, led to negative equities seriously affecting many professionals and the middle class
Ø Provided expert views on major infrastructure projects including proposed Route 10, Wanchai Reclamation II (WRII), Central Reclamation III (CRIII), and the ¡§super jail¡¨ in Hei Ling Chau
Ø Pressed the government to implement mandatory building safety inspection including drainage inspection
Ø Successfully persuaded the government to privatise the MTRC and the Airport Authority

2. Push for more public works to create employment opportunities
±À°Ê¤u°È¤uµ{ ³Ð³y´N·~¾÷·|
Ø Initiated new proposals and kept pressing the government to:
n Increase its investment in infrastructure projects and building works to $29 billion
n Expedite implementation of infrastructure and building works by streamlining procedures
n Resume the 160 projects worth $20 billion previously undertaken by the two former Municipal Councils
n Spend $6 billion each year for upgrading ageing infrastructure and building works

Ø Elected, uncontested each year, as Chairman of the Public Works Subcommittee (PWSC)(¤u°È¤p²Õ) of the Legislative Council and successfully solicited support from political parties to endorse major public works projects in the PWSC such as:

3. Secure engineers¡¦ livelihood and speak for the profession

Ø Successfully persuaded the government to increase infrastructure spending by 10% to $29 billion in the next 5 years
Ø Established on my own initiative and elected as convenor of the Public Works Concern Group (Ãöª`¤½¦@«Ø³]Áp®u·|ij) which comprises 2 other legislators and 12 construction related organisations (interest groups, the largest construction labour union and professional bodies including HKIE) to join forces together to press the government to expedite implementation of its infrastructure projects and building works

Ø Successfully secured jobs in China Mainland for Hong Kong engineers and making continuous efforts to lobby Mainland authorities to offer further employment opportunities
Ø Objected to and voted against government¡¦s introduction of legislation to effect pay reduction of civil servants (¥ßªk´îÁ~) in 2002-03
Ø Led 2 delegations in 2002 and 2003 to Beijing presenting proposals to state leaders on Hong Kong engineers¡¦entry into the Mainland market
Ø Teamed up with the following engineering bodies to promote well-being of engineers:
n 10 government engineers staff associations
n The Association of Consulting Engineers of Hong Kong
n The Hong Kong Construction Association Ltd
n The Hong Kong Federation of E & M Contractors Ltd
Ø Successfully persuaded the Buildings Department to maintain the same number of Chief Structural Engineer grade staff to boost the morale of Structural Engineer grade staff
Ø Successfully convinced the government to recognize Registered Professional Engineers in the IT Discipline as certification authorities under the Electronic Transaction Bill in 2000
Ø Successfully persuaded the KCRC management in 2002 not to allow quantity surveyors to form audit teams on site and come off the Resident Engineering Site Establishment
Ø Solved the problem of unfair employment contract terms of the Vocational Training Council (VTC)
Ø Supported the engineers of the Housing Department to fight against privatisation by joining the sit-in protests, demonstrations and soliciting support from engineers¡¦ staff associations of Works Group Departments
Ø Persistently fighting for opening up of A.O. Grade to engineering officers in the government and opening up of AD posts in the Buildings Department
Ø Striving for better and continued employment opportunities for young engineers working in the government
Ø Fighting for more reasonable employment terms for Resident Engineers
Ø Fighting for transfer of Non-Civil Service Contract Engineers to P & P civil service employment terms or extension of their contracts
Ø Fighting for Registration of Building Services Engineers under the Buildings Ordinance in the long term with the use of R.P.E. (BS) in the interim
Ø Joined the sit-in protest in front of Chief Executive Tung Chee Hwa¡¦s Office and voted against funding cuts for tertiary engineering institutions
Ø Pressing the government to completely delete the existing 3-year imprisonment term and reduce fine from $1.5 million to $250,000 for the offence of failing to notify the Building Authority of any contravention of the Buildings Ordinance that would result from carrying out the works in accordance with approved plans as proposed in the Buildings (Amendment) Bill 2003
Ø Successfully lobbied the creation of engineering directorate posts in HyD, CED, Lands D, HD, etc.
Ø Helped the Electrical and Mechanical Services Department to clear up the misunderstanding of some LegCo members on the Department¡¦s policy in giving out nominal supermarket coupons to increase the morale of its staff
Ø Successfully persuaded the government to include Registered Professional Engineers (Environmental) in the list of ¡§Qualified Engineers¡¨ specified in Regulation 8 of the Air Pollution Control Ordinance

4. Promote social awareness and political culture among engineers

Ø Suggested the Government to set up a Constitutional Review Consultative Committee comprising 1,000 members nominated by all sectors of the community to have full participation and in-depth discussion of the future constitutional arrangements of the HKSAR

Ø Suggested to state leaders that Chief Executive Tung Chee Hwa should lead all 60 LegCo members as one entity to visit Beijing and meet the state leaders

n ¡§Demanding the government to defer the enactment of Article 23¡¨ was the mainstream opinion of engineering professionals
n The majority of engineers felt that there was insufficient consultation. Further elaboration and explanation on numerous provisions of the proposed legislation should be given to citizens so as to eliminate their worries
Ø Supported fellow engineers standing for 1999 and 2003 District Council Elections
Ø Successfully amended the Legislative Council Bill in 1997 to include Fellows, Members and Graduates of IT Division of HKIE as electors in the Information Technology Functional Constituency
Ø Nominated engineers to serve on District Councils and advisory bodies
